Discussion of 99 issues, arising in the following scenario:
An international corporation decides to sign a credit agreement for the financing of the design and construction of three Data Centers in Europe, Asia and America. The Bank recommends the use of FIDIC Conditions of Contract.
The participants acquire skills to prepare tender documents in accordance with the FIDIC Golden Principles, adapted to the specifics of the project. When building a new data center, it is necessary to assess the volume of services provided, the number of users, as well as the conditions of their use (workload, productivity, availability, etc.). There are various requirements for site selection, such as not being in dangerous areas with possible serious natural disasters, being close to several energy sources, etc. There are also special criteria that the data center premises must meet.
Different issues arise under the scenario, related to the main Clauses of the FIDIC Yellow Book «Conditions of Contract for Plant and Design-Build» and Silver Book «Conditions of Contract for EPC/Turnkey Projects».
The goal of the course is not only to analyse the issues and solve the problems, but to train the participants to interpret the contract provisions and follow the FIDIC procedures.
